Haryana High Court Challenges Social-Economic Criteria in TGT Recruitment

The Haryana government's provision of allocating 5 points based on social-economic criteria to families earning up to ₹1.80 lakh annually for TGT (Trained Graduate Teacher) recruitment is facing legal scrutiny in the state.

 Legal Challenge

The Haryana High Court, in response to a petition filed by Arun Kumari and others, has issued an interim order halting the allocation of points based on social-economic criteria. Although the final verdict is pending, this interim decision may impact other recruitments, including the ongoing TGT recruitment drive with 7471 positions.

TGT Recruitment Process

The recruitment process for TGT positions was initiated with an advertisement on February 21, 2023, which included a provision to award 5% points based on social-economic criteria as defined by Class 12 standards. A similar clause was present in a previous December 20, 2022 advertisement regarding Assistant Engineer positions.

 Legal Proceedings and Notices

The case, currently stalled due to ongoing court proceedings, raises questions about the constitutionality of awarding points based on socio-economic factors. The interim order, passed on January 19, 2023, has yet to be finalised, potentially impacting the ongoing TGT recruitment process.

 Notice from the High Court

Justice Deepak Sibal and Justice Sukhvinder Kaur of the Haryana High Court issued a notice of motion on December 15, 2023. The respondents are directed to file their response by January 31, 2024, indicating a comprehensive review of the challenges against awarding 5% points based on social-economic criteria.

While the final decision is awaited, the legal challenge against the allocation of points based on social-economic criteria may reshape recruitment policies in Haryana, ensuring a transparent and fair process that adheres to constitutional principles.
