Congress to Challenge Speaker's Decision on Kiran Chaudhary in Supreme Court

Party leaders claim the dismissal of anti-defection petition against former Congress MLA is unconstitutional and violates the Tenth Schedule

Congress party leaders in Haryana are unhappy with the Speaker's recent decision about Kiran Chaudhary, a former Congress MLA. Bharat Bhushan Batra, the Chief Whip of the Congress Legislature Party, and Aftab Ahmed, the Deputy Leader, held a press conference in Chandigarh to express their concerns. 

They said the Speaker was wrong to dismiss their petition against Kiran Chaudhary. This petition was about Chaudhary leaving the Congress party, which the leaders believe should result in her losing her position as an MLA. The Congress leaders think the Speaker's decision goes against the rules in the Constitution, especially the Tenth Schedule. 

Why Congress Thinks the Decision is Wrong

The Congress leaders explained that according to the Tenth Schedule of the Constitution, if an MLA leaves their party, they should automatically lose their membership in the assembly. They said the Speaker didn't need to wait for a formal petition to take action.

The leaders pointed out that Kiran Chaudhary had already resigned from the Congress party, and the Speaker knew about it. They believe the Speaker should have taken action as soon as Chaudhary left the party. Instead, they say, Chaudhary is still illegally a member of the assembly.

Plans to Go to Supreme Court 

The Congress party isn't giving up. They plan to take this issue to the Supreme Court. They believe the Speaker's decision is not just wrong, but also goes against previous Supreme Court rulings.

The leaders mentioned a specific case from Bihar to support their argument. They said that according to this case, the Speaker should act even if the person who filed the complaint later wants to take it back. This is because the issue is about following the Constitution, not just a dispute between individuals or parties.

Congress Accuses Speaker of Bias

The Congress leaders also accused the Speaker of being biased towards the ruling party. They said the Speaker rejected their petition on a technicality - that it didn't have the right signatures. But the leaders argue that this rule isn't in the Constitution.  They believe the Speaker is deliberately ignoring their complaints because he doesn't want to take action against Kiran Chaudhary. The leaders warned that if the Speaker doesn't listen to them, they will definitely go to the Supreme Court to seek justice. 

This situation shows how complicated political and legal issues can be. The Congress party feels that the rules aren't being followed fairly, and they're ready to fight for what they believe is right, even if it means going to the highest court in the country.
