In a significant judgement to benefit thousands of contractual employees in Haryana, the Punjab and Haryana High Court has mandated the regularization of eligible employees within six months. This judgement has been delivered under Justice Jagmohan Bansal’s bench, providing a clear pathway for contract workers to become permanent government employees.
Eligible Employees
Employees qualifying under the 2003 and 2011 policies are specifically eligible for the permanent government position. Additionally, the successful candidate will receive backdated salary benefits from the date of their court petition filing without any interest. Similarly, those who have already retired will have their pension and other financial benefits recalculated according to the new status.
Although the new ruling excludes employs appointed in 2014 from receiving benefits under any previous policies. Those who are not eligible under the 2003 and 2011 policies will be considered under the new 2024 Act. On the other hand, the Punjab and Haryana High Court has criticized the 2014 notification suggesting that it contradicts the Supreme Court's 2006 Uma Devi judgement.
Six Months Timeline
High Court has ordered the government to review the status of all employees who could be eligible for regularization under various policies and emphasized to complete the regularization process within six months. High Court also ordered to make sure that no eligible employee should be denied their rights without a proper cause.
