In a landmark judgment defending retiree rights, the Punjab and Haryana High Court has taken a strong stance against the Haryana government's mistreatment of a former Director of Secondary Education. The court's decision highlights the growing concern over the harassment of retired government employees seeking their rightful benefits.
The case revolves around a retired director who waited four and a half years after his retirement in May 2016 to receive his gratuity payment. The court found that the state government had baselessly withheld the payment, falsely claiming pending dues for government accommodation.
Justice Tribhuvan Dahiya didn't mince words in his judgment, calling the state's actions "sheer high-handedness and misuse of power." The court has ordered that the Rs 75,000 compensation be recovered from the officers responsible for the delay, marking a significant shift in holding officials personally accountable for administrative negligence.
"An employer must compensate employees with interest for harassment caused by withholding retirement benefits without justification," stated Justice Dahiya, setting a precedent for similar cases. The court has given the state six months to complete the recovery process, with the Chief Secretary required to file a compliance report within four weeks thereafter.
This case serves as a wake-up call for state administrators and highlights the need for prompt processing of retirement benefits. The judgment ensures that retired employees can look forward to better protection of their rights in the future.
